DMCA & Takedown Policy

Agensi respects the intellectual property rights of creators and third parties. This policy describes how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and equivalent provisions under European Union law, including the EU Copyright Directive (2019/790).
1. Designated Agent
Agensi's designated agent for receiving copyright infringement notifications is:

2. Reporting Copyright Infringement
If you believe that content hosted on Agensi infringes your copyright, you may submit a takedown notification to our designated agent. Your notification must include:
- Your full legal name and contact information (email address and, optionally, mailing address and phone number).
- A description of the copyrighted work you claim has been infringed, or, if multiple works are involved, a representative list.
- A description of the material you claim is infringing and its location on the Platform — provide enough detail for us to locate it (e.g., the skill listing URL, the skill name, or the creator's username).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.

Incomplete notifications may not be actionable. If your notification is incomplete, we will make a reasonable attempt to contact you for the missing information.
3. How We Process Takedown Requests
Upon receiving a valid takedown notification, Agensi will:
- Acknowledge receipt of the notification within 3 business days.
- Review the claim. If the claim is valid and the material can be identified, we will promptly remove or disable access to the infringing material. This includes removing the skill from both the download system and the MCP server so it is no longer accessible to subscribers or buyers.
- Notify the Creator whose skill was removed, including a copy of the takedown notification (with the complainant's personal information redacted as appropriate), and inform them of the counter-notification process.
- Record the takedown for compliance and enforcement purposes.
4. Fingerprint-Based Reporting (Agensi Creators)
Agensi provides an additional piracy reporting tool for Creators who sell skills on the Platform. This tool leverages Agensi's buyer fingerprinting system and is separate from the formal DMCA process.
If you are an Agensi Creator and you discover your skill has been redistributed without authorization:
- Go to your Creator Dashboard and select the affected skill.
- Click "Report Piracy" and paste the leaked SKILL.md content or provide the URL where the infringing material is hosted.
- If the leaked content contains a valid Agensi fingerprint, we will identify the buyer account associated with that fingerprint and present enforcement options: issue a warning to the buyer, suspend the buyer's account, or generate a DMCA takedown notice for external platforms (e.g., GitHub, other hosting services).
- If the fingerprint has been stripped or is not present, we will log the report and provide you with a DMCA takedown notice template you can submit to the hosting platform directly.
- You can view the history and status of all piracy reports for each skill in your dashboard.
Note: Skills accessed by Agensi Pro subscribers via the MCP server are streamed at runtime and are not fingerprinted in the same way as file downloads. MCP access is logged and attributable to individual subscriber accounts. If you suspect that a subscriber has captured and redistributed skill content obtained via MCP, report it through the same piracy reporting flow. Agensi will investigate using MCP access logs.
This tool is intended to supplement, not replace, the formal DMCA process. For infringement by parties outside the Agensi platform, you should submit a DMCA takedown notification directly to the hosting platform where the infringing material is located.
5. Counter-Notifications
If you are a Creator whose skill has been removed pursuant to a takedown notification and you believe the removal was made in error, you may submit a counter-notification. Your counter-notification must include:
- Your full legal name and contact information.
- Identification of the material that was removed and its location on the Platform prior to removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the competent courts in the Netherlands for the purpose of resolving the dispute, and that you will accept service of process from the party that submitted the takedown notification.
- Your physical or electronic signature.
Send your counter-notification to: info@agensi.io with the subject line "DMCA Counter-Notification".
Upon receiving a valid counter-notification, Agensi will:
- Forward the counter-notification to the party that submitted the original takedown request.
- Inform the original complainant that the removed material will be restored in 10 business days unless the complainant notifies us that they have filed a court action seeking to restrain the Creator from engaging in the allegedly infringing activity.
- Restore the material within 10 to 14 business days after receiving the counter-notification, unless we receive notice of a court action from the original complainant. Restoration includes re-enabling both download access and MCP server access for the skill.
6. Repeat Infringers
Agensi maintains a policy of terminating the accounts of users who are repeat infringers. If a Creator receives multiple valid takedown notifications, Agensi may permanently remove their listings and suspend their account. If a Buyer or Subscriber is identified as having redistributed purchased or MCP-accessed skills on multiple occasions (whether through fingerprint matching, MCP access log analysis, or other means), Agensi may permanently suspend their account, revoke MCP access, and revoke access to all purchased skills.
7. Misrepresentation
Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Do not submit a takedown notification or counter-notification unless you have a genuine, good-faith basis for your claim.
8. Limitation
Agensi is a marketplace and does not create, author, or endorse the skills listed on the Platform. While we take reasonable steps to review skill submissions and respond to infringement claims, we cannot guarantee that all content on the Platform is free from infringement.
